Letterly is a platform for sending messages to the future. By using our service, you agree to act responsibly and respect the platform and other users. Our terms are designed to ensure a safe and reliable experience for everyone.

1. Acceptance of Terms

By accessing or using Letterly ("the Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.

The Service is provided by Okike Labs. We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

2. Description of Service

Letterly is a digital platform that allows users to compose, schedule, and deliver electronic letters to specified recipients (including themselves) at a future date.

The Service includes account management, letter composition tools, scheduling systems, and email delivery mechanisms. We provide the Service "as is" and strive for maximum reliability, though we do not guarantee uninterrupted availability.

3. Eligibility and Registration

You must be at least 13 years of age to use the Service. If you are under 18, you represent that you have obtained parental or guardian consent.

To access certain features, you must create an account with a valid email address. You are responsible for:

  • Providing accurate and complete information during registration.
  • Maintaining the security and confidentiality of your account credentials.
  • Updating your email address to ensure letters can be delivered to you if you are the intended recipient.
  • All activities that occur under your account.

4. Content and Ownership

You retain all ownership and intellectual property rights to the letters you compose ("User Content"). We do not claim ownership of your content.

By using the Service, you grant Letterly a limited, worldwide, royalty-free license to store, process, and transmit your content solely for the purpose of providing the Service (e.g., delivering your scheduled letters).

You are solely responsible for your content and must not send material that is illegal, harmful, threatening, abusive, defamatory, or infringes on the rights of others.

5. Delivery Limitations and Disclaimers

We make commercially reasonable efforts to deliver letters on the scheduled date and time. However, you acknowledge that delivery depends on factors beyond our control, including:

  • The accuracy of the recipient's email address provided by you.
  • The functionality of recipient email servers and spam filters.
  • Internet connectivity and network stability.
  • The continued existence and validity of the recipient's email account at the time of delivery.

6. Account Termination

You may delete your account at any time. Upon account deletion, all scheduled letters associated with your account that have not yet been delivered will be permanently removed and will NOT be delivered.

We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our sole discretion.

7. Limitation of Liability

IN NO EVENT SHALL OKIKE LABS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, DATA, OR USE, ARISING FROM MISSED OR DELAYED LETTER DELIVERIES.

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR THE SERVICE.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Okike Labs is registered.
